Terms and Conditions - 16 Week Contract

Private Coaching

Services:

  • Online 16-week program commitment

  • Programming and goal setting

  • App messenger for accountability, feedback and support.

  • Access to the Elevate Fitness Facebook community group.

  • 30 mins zoom check in call scheduled every 4 weeks.

Price & Payment

  • Where payment is via direct debit through the third-party provider of our choice, you agree to pay the instalment amount at the agreed payment frequency for the term of the Agreement. You may alter the payment frequency with the third-party direct debit provider by requesting a change directly to the third-party direct debit provider. Any changes made shall not affect the total amount of money you would otherwise be required to pay. Should there be any payments arrears, you authorise the third-party direct debit provider to debit the outstanding balance in order to bring the account up to date.

  • You authorise the third-party direct debit provider to add any fees owing with regard to administration fees or late payment fees. You acknowledge that the third-party direct debit provider is entitled to store your personal information, which can be amended in accordance with the Privacy Act 1988 (Cth).

  • In accordance with this Agreement, you acknowledge that you have read, understood and agree to the terms and conditions of the third-party direct debit provider.

  • We will charge you the Price for the Licence: As indicated on invoices provided to you;

  • As per a written quote; or As advertised.

  • Payments are completed via CC authorisation of Stripe Payments.

    *Please note all payments are final and non-refundable.

  • Payments will be made by Cash, Cheque, Bank Cheque, Direct Credit (EFT) , Credit Card (plus surcharge of up to three percent (3%) of the invoiced amount, or four and one half percent (4.5%) of the invoices amount if payment is made by American Express card, or any other method as agreed to between the Customer and us, in writing.

  • If payments are late, the paying party shall be liable to pay a late fee of $50 AUD per occurrence, as specified in this contract. Failure to make timely payments may result in suspension of services and/or initiation of legal action by the receiving party.

  • We reserve the right to change the Price at any time.

  • If you do not pay within the payment term, you agree that we may:

  • Charge interest until the date of payment at rate of ten (10%) per annum.

  • Charge an administration fee of the greater of ten (10%) of the amount overdue or $200.00; Revoke the Licence.

Rolling Contract

  • Once the 16 week period is up, the program moves across to a rolling contract basis.

  • The rolling contract period is done across a 4 week period

  • The payment cycle will continue automatically after commencement unless a request for termination is received in advance.

  • To terminate the contract and cease future payments, please provide written notice at least 7 days before the next billing cycle. Upon receipt of your termination request, payments will be discontinued, and services will be concluded at the end of the current billing period.

Cancellation & Refunds

  • If you terminate our services early (prior to the completion of the 16-week program), you acknowledge and agree that the outstanding fees for those services are payable.

  • You agree to ensure sufficient funds are available in your nominated bank account to meet any account withdrawals made by us.

Liability

By participating in this online coaching program, you acknowledge and understand that while every effort is made to provide accurate guidance, Elevate Fitness Australia cannot physically observe or monitor your exercises and technique. You acknowledge that there are inherent risks associated with physical activities and training, and you assume full responsibility for any risks, injuries, or damages that may occur during or as a result of following the program or advice provided.

Elevate Fitness Australia and its coaches are not liable for any injuries, accidents, or health problems that may arise from your participation in this online coaching program. It is recommended that you consult with a physician before starting any new fitness regimen. By engaging in this program, you agree to release Elevate Fitness Australia, its affiliates, employees, and agents from any and all claims, liabilities, or damages arising from or in connection with your participation.

Agreement

This agreement is binding, and the client agrees to pay all payments in full and cannot cancel under any circumstances.
